HIGH COURT DECISION
Civil servants seeking elective office in the August election are required to resign
Last week, The High court struck out a petition challenging the enforcement of Section 43(5) of the Elections Act which requires civil servants seeking elective office to resign six months before the date of the General Election.
The petitioner had alleged that it was discriminatory to force civil servants to resign as a pre-requisite qualification to vie for elective seats, while their rivals in the private sector and those holding political positions remained in office.
However, The judge struck out the petition and stated that 6 months is sufficient for a candidate to prepare himself/herself for an election.
Looking forward
As per the ruling, Public officers seeking elective seats on August 9 2022, have till 9th February to resign.
